The terms that apply when you use our website and services.

1. Acceptance of Terms
1.1 Binding Agreement
By accessing or using our services you confirm that you have the legal capacity and authority to enter into this agreement and agree to comply with these Terms.
1.2 Changes to Terms
We may update these Terms at any time. Where changes are significant we will make reasonable efforts to notify you. Continued use of our services constitutes acceptance of the updated Terms.
1.3 Agreement
By engaging with Edweb Media or making any payment you confirm that you have read, understood and agreed to these Terms.
2. Eligibility
Our services are intended for individuals or businesses aged 18 and over who have the legal capacity to enter into binding agreements and comply with applicable laws.
3. Services Overview
Edweb Media provides website design, branding, social media management and related digital services. Our pricing model works as follows:
- Website design is a once-off fee. You pay once for the design and build of your website.
- Hosting is a separate optional monthly add-on. It is not included in the once-off design fee.
- Website management is a separate optional monthly add-on. It is not included in the once-off design fee.
- Both hosting and management are optional ongoing services. You may choose either, both, or neither.
4. Once-Off Website Design
4.1 Deposit and Commencement
A non-refundable deposit of 50 per cent of the agreed design fee is required before any work begins. By paying the deposit you confirm your commitment to the project and authorise Edweb Media to proceed.
An estimated project timeline will be provided at the start. Delivery timelines may vary depending on client response times and availability of content.
4.2 Final Payment
The remaining balance is due upon completion or at the agreed milestone and must be paid within 14 days of the completion notice.
4.3 Handover of Files
Website files, design work and setup will only be handed over once all outstanding fees have been paid in full. No files will be released while any balance remains outstanding.
4.4 Ownership
Ownership of the completed website transfers to the client only after full payment of the once-off design fee has been received. Until then, all work remains the property of Edweb Media.
4.5 No Refunds
All deposits and payments for completed work are non-refundable. Work completed to the agreed scope will not be reversed or refunded.
4.6 Scope of Work
The once-off design fee covers the agreed scope of work. Any additional pages, features or changes outside the original scope will be quoted separately and must be approved before work begins.
4.7 Project Delays and Abandonment
If the client fails to provide required content, information or feedback for 14 or more days the project may be considered inactive. Edweb Media reserves the right to pause work, reschedule the project or apply a restart fee before continuing.
4.8 Client Responsibilities
You agree to provide all required content and materials in a timely manner. You confirm that all content provided is accurate and lawful, that you hold the rights to all materials supplied and that you are responsible for compliance with applicable laws. Edweb Media is not liable for any issues arising from client-provided content.
5. Hosting (Optional Monthly Add-on)
5.1 What Hosting Includes
The hosting add-on covers website hosting and a professional email address. It is billed monthly and is separate from the once-off design fee.
5.2 Payment and Due Date
Hosting fees are due on the first day of each calendar month unless otherwise agreed in writing. Services are provided on a month-to-month basis.
5.3 Late Payments and Suspension
If a hosting payment is not received within 14 days of the due date, Edweb Media reserves the right to suspend hosting services, including website access and professional email, until payment is received. We will make reasonable efforts to notify you before suspending services.
Repeated late payments may result in immediate suspension after the due date without further notice.
5.4 Cancellation
Hosting can be cancelled at any time by notifying us in writing before the start of a new billing cycle. If cancellation is received after a new cycle has started, you remain responsible for that month's payment and the cancellation will take effect at the end of that billing period. All hosting fees are non-refundable.
5.5 Domain Management
Where a domain is set up as part of your package, Edweb Media will manage and renew it on your behalf for as long as hosting services remain active. Domain ownership remains with the client. If hosting is cancelled, the client becomes responsible for their own domain management and renewal.
6. Website Management (Optional Monthly Add-on)
6.1 What Management Includes
The website management add-on includes up to one hour of monthly work covering website updates, plugin updates, theme updates, basic content updates and general website maintenance. It is billed monthly and is separate from the once-off design fee.
Website management includes up to one hour per month only. Any work beyond the included monthly hour must be quoted separately or billed as additional work before it begins.
6.2 Payment and Due Date
Management fees are due on the first day of each calendar month unless otherwise agreed in writing.
6.3 Late Payments and Suspension
If a management payment is not received within 14 days of the due date, Edweb Media reserves the right to suspend management services until payment is received.
6.4 Cancellation
Management can be cancelled at any time by notifying us in writing before the start of a new billing cycle. All management fees are non-refundable.
6.5 Scope of Management
Management packages cover standard monthly tasks within the allocated hour. Work beyond this scope will be quoted separately and must be approved before it begins.
6a. E-commerce Website Design
The once-off e-commerce package price covers the website build only. It does not include ongoing monthly store management, product updates, sales support, content changes or regular website changes. These are available as a separate monthly management add-on.
6b. Directory Website Pricing
Directory website pricing shown on our packages page is a guide. Final pricing may vary depending on the number of listings, features required, filters, booking functionality, user accounts, third-party integrations and any custom requirements specific to your project. A finalised quote will be provided before work begins.
6c. Online Payments and Card Transactions
6c.1 Payment Processor
Online payments to Edweb Media are processed through Payfast (Pty) Ltd, a registered South African payment gateway. When you pay online you are redirected to Payfast's secure checkout to complete the transaction. For more information about Payfast, visit payfast.io.
6c.2 Accepted Payment Methods
We accept Visa and Mastercard credit and cheque (debit) cards, and Instant EFT, through Payfast.
6c.3 Card Security
Card details are entered on Payfast's secure, encrypted checkout and are handled by Payfast, a PCI DSS compliant payment service provider. Your customer details are kept by Edweb Media separately from your card details, which are entered by you on Payfast's secure site. Edweb Media does not see, handle or store your full card details at any time.
6c.4 Merchant Outlet Country and Currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. All prices are shown and charged in South African Rand (ZAR).
6c.5 Recurring (Subscription) Payments
Monthly hosting and website management are billed as recurring subscriptions through Payfast. By setting up a monthly plan you authorise Edweb Media, through Payfast, to automatically debit your chosen card each month for the agreed amount until you cancel. Where a plan includes a once-off website design fee, the design fee is charged first and the monthly amount begins from the following month. The recurring amount and the billing date are shown to you before you confirm.
6c.6 Cancelling a Subscription
You may cancel a monthly subscription at any time by notifying us in writing at info@edwebmedia.com before your next billing date. Cancellation stops all future debits. Amounts already charged for the current or previous billing periods are not refunded.
6c.7 Failed or Declined Payments
If a recurring payment fails or is declined, we may reattempt the payment and may suspend the related service until payment is received, in line with the non-payment terms in this agreement.
6c.8 Refunds
Website design fees, deposits and monthly hosting and management fees are non-refundable, as set out elsewhere in these Terms. Where a refund is agreed by Edweb Media in writing in exceptional circumstances, it will be processed through Payfast to the original payment method used.
7. Non-Payment and Service Control
In the event of non-payment of any outstanding fee, Edweb Media reserves the right to suspend or restrict services, including taking the website offline, disabling hosting, suspending email access and restricting administrative access to systems.
Services will only be restored once all outstanding balances are paid in full.
Website files, design work and setup will not be handed over while any balance remains outstanding, regardless of the type of fee owed.
8. User Conduct
You agree not to use our services for unlawful purposes or engage in activities that may harm our services or reputation.
9. Intellectual Property
All materials created by Edweb Media remain our property until full payment has been received. You may not reproduce or reuse any work without permission until ownership has transferred. Edweb Media reserves the right to display completed work in its portfolio and marketing materials unless otherwise agreed in writing.
10. Data and Backups
While reasonable efforts may be made to maintain backups, Edweb Media does not guarantee the availability or recovery of any data. The client is responsible for maintaining their own backups.
11. Disclaimers
11.1 Service Provided As Is
All services are provided as is without warranties of any kind.
11.2 No Guarantees
We do not guarantee uninterrupted or error-free service.
11.3 No Performance Guarantees
We do not guarantee search rankings, traffic, leads or sales.
11.4 Third Party Services
We are not responsible for issues caused by third-party providers including hosting infrastructure, plugins or integrations.
11.5 Right to Refuse Service
Edweb Media reserves the right to refuse or terminate services if a client's activities are unlawful, unethical or harmful to our business.
12. Limitation of Liability
To the fullest extent permitted by law, Edweb Media is not liable for indirect or consequential damages including loss of profits, data or business opportunities.
13. Indemnification
You agree to indemnify and hold Edweb Media harmless from any claims arising from your use of our services or violation of these Terms.
14. Governing Law and Country of Domicile
These Terms are governed by the laws of the Western Cape, South Africa. Edweb Media chooses South Africa as its country of domicile for the purposes of these Terms. Edweb Media is a business based in Cape Town, Western Cape, South Africa.
15. Termination
We may terminate services immediately if these Terms are breached or if termination is required to protect our business.
16. General
If any part of these Terms is found to be unenforceable, the remaining sections remain valid. These Terms represent the full agreement between you and Edweb Media.
